These terms and conditions apply to any purchase made through this website.

TERMS AND CONDITIONS

1. Definitions

"Conditions" means the terms and conditions of sale set out below and any special terms agreed in writing between Real Life Solutions and the Customer

"Customer" means the person who makes an offer to buy goods from Real Life Solutions through this website.

"Goods" means the articles and/or services which the Customer offers to buy from Real Life Solutions.

"Price" means the price for the Goods.

2. Conditions applicable

2.1 All orders for Goods made by a Customer shall be deemed to be an offer by the Customer to purchase Goods pursuant to these Conditions. Nothing contained in this website or in these terms and conditions shall be an offer which is capable of being accepted by a Customer or by any other person or of being in any way binding on Real Life Solutions. Acceptance by Real Life Solutions of an offer by a Customer shall take effect on the dispatch by Real Life Solutions of the Goods.

2.2 Any variations to the Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by Real Life Solutions.

2.3 Nothing in the Conditions shall affect the statutory rights of any consumer.

3. The Price and payment

3.1 The Price shall be the price quoted by Real Life Solutions on this website. The Price is inclusive of VAT but exclusive of post and packing, unless otherwise specified.

3.2 Real Life Solutions shall not be bound to deliver the Goods until the Customer has paid for them.

4. Delivery

The Goods shall be delivered by post to the Customer at the address given by the Customer. Please allow 7 days for delivery (goods are usually dispatched within 2-3 days). Should the goods not arrive within this timescale, we would ask that you contact us by phone or email as soon as possible.

Liability

The liability of Real Life Solutions shall be
5.1 unlimited in respect of negligence causing the death of or personal injury to any person
5.2 unlimited in respect of breaches of implied terms as to description, satisfactory quality and fitness for purpose and
5.3 limited in all other cases to an amount equal to the contract price

6. Acceptance of the Goods

6.1 Acceptance of the Goods occurs when the Goods are delivered to the Customer.

6.2 Real Life Solutions may at its absolute discretion agree to replace Goods which are not defective.

7. Title and Risk

Title & risk shall pass on receipt of the Goods, by the customer.

8. Cancellation

8.1 Where the Customer deals as a consumer as defined by the Consumer Protection (Distance Selling) Regulations 2000 the Customer may cancel the contract by giving written notice (or via email) to Real Life Solutions within 7 days of receipt of the Goods, beginning with the day after the day on which the Customer receives the Goods.

8.2 If the Customer validly cancels the contract, they must return to the Goods to Real Life Solutions within 14 days of receipt, including the delivery date itself. Until they return the Goods, the Customer must retain possession of the Goods and take reasonable care of them. Reasonable care means that the sealed foil containers, where applicable should remain intact.

8.3 Within 30 days of cancellation, Real Life Solutions will
8.3.1 reimburse the Price in full to the Customer less any costs incurred in recovering the Goods if the Customer fails to return them.

9. Guarantees

9.1 Tests - We make every effort to explain the basis of the fertility tests sold but we do encourage you to contact us directly if you have any questions about our tests or if you require any additional help or information PRIOR to using them.

9.2 There is no guarantee of pregnancy achievement with any of our products.

10. Applicable law

This agreement is governed by the law of England and Wales.

11. Third party rights

For the avoidance of doubt nothing in the Conditions shall confer on any third party any benefit or the right to enforce any term of the Conditions

12. Complaints

If you have a complaint to make, please make it in writing or via email. Every complaint will be acknolwledged within 5 working days, at which point we will advise you how long it will take to resolve your complaint and what the remedy will be. You will be advised throughout the process what stage you are at.
